對WTO競爭政策議題的認識－－從杜哈部長宣言談起胡祖舜本文作者為行政院公平交易委員會企劃處科長。壹、背景說明2001年11月世界貿易組織(WTO)第四屆杜哈(Doha)部長會議，就有關貿易與競爭政策的互動，通過了以下三段決議文23.Recognizingthecaseforamultilateralframeworktoenhancethecontributionofcompetitionpolicytointernationaltradeanddevelopment,andtheneedforenhancedtechnicalassistanceandcapacity-buildinginthisareaasreferredtoinparagraph24,weagreethatnegotiationswilltakeplaceaftertheFifthSessionoftheMinisterialConferenceonthebasisofadecisiontobetaken,byexplicitconsensus,atthatsessiononmodalitiesofnegotiations.24.Werecognizetheneedsofdevelopingandleast-developedcountriesforenhancedsupportfortechnicalassistanceandcapacitybuildinginthisarea,includingpolicyanalysisanddevelopmentsothattheymaybetterevaluatetheimplicationsofclosermultilateralcooperationfortheirdevelopmentpoliciesandobjectives,andhumanandinstitutionaldevelopment.Tothisend,weshallworkincooperationwithotherrelevantintergovernmentalorganisations,includingUNCTAD,andthroughappropriateregionalandbilateralchannels,toprovidestrengthenedandadequatelyresourcedassistancetorespondtotheseneeds.25.IntheperioduntiltheFifthSession,furtherworkintheWorkingGroupontheInteractionbetweenTradeandCompetitionPolicywillfocusontheclarificationof:coreprinciples,includingtransparency,non-discriminationandproceduralfairness,andprovisionsonhardcorecartels;modalitiesforvoluntarycooperation;andsupportforprogressivereinforcementofcompetitioninstitutionsindevelopingcountriesthroughcapacitybuilding.Fullaccountshallbetakenoftheneedsofdevelopingandleast-developedcountryparticipantsandappropriateflexibilityprovidedtoaddressthem.：23.基於承認多邊架構對促進競爭政策對國際貿易發展可提供的供獻，並承認第24段所提及在此領域內的更進一步技術協助與能力建制的需要，部長們因此同意，將在第五屆部長會議後，基於在該屆部長會議依照明白的共識所另行作成的決議，就將來談判的形式，展開談判。24.部長們承認開發中國家與低度開發國家在此領域中獲得進一步技術協助與能力建制的需要(包括政策分析與發展，使其更可以評估更緊密的國際合作對其經濟發展之政策及目標、以及人力與機構發展，可能產生的含意)。為達此目的，吾等應與其他相關政府間組織(包括UNCTAD)合作，並透過適當的區域性與雙邊管道，對此種需求，提供強化的且足夠資源的協助，以作為回應。25.在第五屆部長會議召開前的這段期間，貿易與競爭政策互動工作小組的進一步工作，將著重在澄清：核心原則(包括透明化、不歧視與程序的公平性、及核心卡特爾的規定)；自願性合作的形式；以及透過機構建制，支持開發中國家競爭機構的逐漸強化。就此，開發中國家與低
