摘要在现代社会，家庭暴力一直是社会的公认的社会问题，而其中家庭冷暴力行为随着时代的变迁发生的频率越来越频繁，致使其成为越来越严重的问题，对其进行法律规制笔者认为极其必要，所以现在必须引起我们的重视。本文中笔者采用比对研究法、分析法进行研究。首先从阐述什么是家庭冷暴力出发，进一步了解家庭冷暴力带来的危害，分析家庭冷暴力发生的原因，说明其危害性。得出对家庭冷暴力进行法律规制的必要性，并且通过论述学者对规制家庭冷暴力的观点，引出笔者观点。第二通过分析各国对家庭冷暴力的相关法律规定，发现我国对家庭冷暴力进行法律规制的问题，并且针对问题提出合理的完善建议。本文对家庭冷暴力进行概述加深大众对家庭冷暴力这个概念理解，以及由此产生的家庭内部危害，社会危害等使其认识到家庭冷暴力的严重危害性，通过比对分析各国的法律现状看到我国对家庭冷暴力进行规制的可能性以及必要性，表达笔者的观点。达到促进对冷暴力进行法律规制的目的，从而尽可能的减少家庭冷暴力的发生，进一步降低离婚率，促进社会和谐稳定的发展。关键词：家庭冷暴力；家庭暴力；举证责任；立法现状；完善措施AbstractInmodernsociety,domesticviolencehasbeentheacceptedsocialproblemsofthesociety,andthefamilyofcoldviolenceasthechangeofTheTimesthHYPERLINK"javascript:;"efrequencyofmoreandmorefrequent,makingitbecomemoreandmoreseriousproblem,isextremelynecessarytoitslegalregulatingtheauthorthinksthat,sonowmustcauseourattention.Inthispaper,theauthoradoptsthemethodofcomparativestudyandanalyticalmethod.Firstofall,fromwhatisdomesticcoldviolence,weshouldfurtherunderstandtheharmofdomesticcoldviolence,analyzethecausesofdomesticcoldviolence,andexplainitsharm.Itisconcludedthatitisnecessarytoregulatedomesticcoldviolencebylaw,andtheauthor'sviewisdrawnbydiscussingtheviewsofscholarsonregulatingdomesticcoldviolence.Secondly,throughtheanalysisofrelevantlawsandregulationsondomesticcoldviolenceinvariouscountries,itisfoundthatChinahaslawsandregulationsondomesticcoldviolence,andputsforwardreasonableSuggestionsforimprovement.Overviewinthispaper,thefamilyofcoldviolencetodeepenthepublicunderstandingoftheconceptoffamilyofcoldviolence,andtheresultingwithinthefamily,socialharmandsoontomakeitrealizedtheseriousharmfulnessoffamilyofcoldviolence,throughthecomparisonanalysisofpresentstatusoflawsinChinatoseethefamilyofcoldviolencepossibilityandnecessityofregulatingtheexpressionoftheauthor'spointofview.Topromotethelegalregulationofcoldviolence,soastominimizetheoccurrenceofdomesticcoldviolence,furtherreducethedivorcerate,andpromotethedevelopmentofsocialharmonyandstability.Keywords:mentalviolence；domesticviolence；burdenofpersuasion；currentsituatio
