沈阳城市学院毕业设计（论文）论法治社会中的人权保障专业：法学班级：14级2班学号：141341241姓名：孟庆阳指导教师：康雨婷答辩日期：2018年6月日沈阳城市学院毕业设计（论文）PAGE\*MERGEFORMAT17摘要法制与人治表面上看似矛盾，实则内部是统一的。法制与人权是密不可分的，他们互相影响，互相作用具有内在的一致性。首先法律必须是良法，而人权可以作为判断法律善恶的标准。其次，在当下的法治社会中，法律一直作为人及其人权的保障而存在，反过来，人和人权也能够加强法律的自我完善。最后，法治一直都是人权得到保障的关键的支撑和动力。从本来的层面进行分析，在法治社会里，利用法律来保障人权是非常重要的，有以下五个原因。第一点，人作为社会主体必须要求法律对其进行保障。第二点，人的自由本性要求法律对其人权进行保障。第三点，人的追求利益的本性要求法律保障人权。第四点，利用法律保护人权对于激发人的主体积极性和创造性有好处。第五点，利用法律保障人权一定要发挥权利本位思想，摒弃义务本位的思想。社会主义法治进程里的人权保障，表现是法律从多方面，多层次，多种类的人权保障，不仅存在立法保护，也存在人权的司法保护，也存在人权的宪法保障，又存在人权的民法保障，刑法保障，行政法人权保障以及诉讼法人权保障等。关键词：法制;人治;人权保护;法律保护AbstractTheruleoflawandruleofmanseemcontradictoryonthesurface,butinternallytheyareunified.Theruleoflawiscloselyrelatedtohumanrights.Theyinteractandinteractwitheachotherandhaveinternalconsistency.First,thelawmustbeagoodlaw,andhumanrightscanbeusedasacriterionforjudgingthegoodandevilofthelaw.Secondly,inasocietyruledbylaw,lawalwaysexistsforhumanbeingsandhumanrights,andhumanrightscanpromotetheselfperfectionoflaw.Thirdly,theruleoflawisalwaysanindispensablefulcrumfortherealizationofhumanrights.Fromitsownpointofview,intheruleoflaw,weshouldpayattentiontothefollowingreasons:theprotectionofhumanrights.First,thelegalprotectionofhumanrightsisthemainrequirementofhumanbeings.Second,thelegalprotectionofhumanrightsisthenatureofhumanfreedom.Third,thelegalprotectionofhumanrightsistheessentialrequirementofpeople'spursuitofinterests.Fourth,thelegalprotectionofhumanrightsisconducivetomobilizingthesubjectivity,initiativeandcreativityofhumanbeings.Fifth,thelegalprotectionofhumanrightsmustpublicizetherightstandardandcurbtheobligationstandard.Theprotectionofhumanrightsintheprocessoftheruleoflawembodiestheprotectionofhumanrightsfromvariouslevels,typesandvariousaspects,bothlegislativeandjudicialprotection,whichnotonlyhavetheprotectionoftheconstitution,butalsotheprotectionofcivillaw,theprotectionofcriminallaw,theprotectionofadministrativelawandtheprotectionofthelitigationlaw.Keywords:
