PAGE\*MERGEFORMATIV摘要《中华人民共和国刑法》第305条规定，伪证罪是指在在刑事诉讼中，证人、鉴定人、记录人和翻译人对于案件有重要关系的情节，故意作虚假证明、鉴定、记录和翻译，意图诬陷他人或者隐藏犯罪证据的行为。本文从我国伪证罪的犯罪构成要件入手，分析了以他为代表的犯罪。伪证罪在国际上的历史比较的悠久，而且我国刑法对此的规定都非常早。但是各个国家立法的本意和初衷都各不相同。所以，我国的刑法对其的规定和国外也存在很大的差别，毋庸置疑的是97刑法是对伪证罪的规定最完善，深化和进一步明确了我们对于伪证罪本质的认识。现在的社会发展的速度非常快，很多地方都需要法律去保护，司法的环境也随着经济的变化发生了很大的改变。所以，我们仍然用以前的环境下制定法律来规范今天的行为显然是不太合理的，这么做也使得立法跟不上经济的发展。所以，本文从伪证罪的构成要件处罚，找出伪证罪和其他相关犯罪之间的界限，并通过对认定难点的探讨，对现行的刑法构成提出伪证罪应当做出怎样地改进，表达其迫切的现实需要。关键词：伪证罪；伪证行为；犯罪构成；虚假证明ABSTRACTArticle305oftheCriminalLawofthePeople'sRepublicofChinastipulatesthatthecrimeofperjuryreferstothefactthatinthecriminalproceedings,thewitness,theappraiser,therecorderandthetranslatorhaveanimportantrelationshipwiththecase,deliberatelymakingfalsecertificates,identification,recordsandtranslations.Theactofframingothersorhidingevidenceofcrime.Basedonthecontroversialsituationinjudicialactivities,thispaperstartswiththecriminalelementsofperjurycrimeinChina,andfocusesonthecrimesrelatedtoperjuryinChina.Thecrimeofperjuryisstipulatedinthecriminallawofothercountriesintheworldtoday,andthereforebelongstoaveryoldcrimeinthefieldofcriminallaw.However,becausethelegislativesourcesofdifferentcountriesarenotsimilar,differentlegislativerequirementsarealsoproposedforthedefinitionofperjury.AsfarasChina'scriminallawisconcerned,thereisnodoubtthatthenewlyrevisedcriminallawin1997isamajorreturntothenatureofperjury,deepeningandfurtherclarifyingourunderstandingofthenatureofperjury.Alongwiththerapiddevelopmentofmodernsociety,thejudicialenvironmentandsocialbackgroundhaveundergonesignificantchanges.Wecannotrelyontheoldnormativestructuretocarrythenewnormativevalueoftoday'ssociety.Fromtheperspectiveoftheconstituentelementsofperjurycrime,thispaperanalyzesthelegislativepurposeofperjurycrime,discussestheacademiccontroversyaboutperjurycrime,discriminatestheboundarybetweenperjuryandrelatedcrimes,andreflectsonthecurrentcriminallawthroughthediscussionoftheabovedifficulties.Howtoimprovethecrimeofperjuryandexpressitsurgentpracti
