服刑人员医疗权研究摘要以服刑人员健康权保障为核心的监狱人权保障不仅能够直接折射出国家人权保障的现状，更反映了社会文明与民主法治的进程，还关系着我国在新时期构建和谐、文明、法治监狱的目标能否实现。本文以服刑人员医疗权作为研究对象，分六部分进行了论述。第一部分主要介绍了文章的研究背景、研究目的及意义以及研究概况；第二部分主要介绍了服刑人员的权利，包括权利的概念、服刑人员权利的概念以及服刑人员应该享有的权利三个方面；第三部分对医疗权进行了相应的介绍，包括医疗权概念的界定、医疗权的内容和医疗权人权属性的分析三个方面；第四部分主要介绍了我国服刑人员医疗权存在的问题与不足，包括对服刑人员提供的医疗卫生资源较为匮乏、服刑人员的紧急救治权遭到侵害、对服刑人员医疗权的行政职责缺位、对服刑人员医疗权的司法救济缺位四个方面；第五部分针对以上存在的问题提出了相应的保障措施，包括更新对服刑人员的传统观念和服刑人员基本医疗权保障的制度构建两个方面，以期为我国服刑人员的医疗权的保护提供相应的参考和依据。关键词：服刑人员；医疗权；监狱StudyOnPrisonersfrommedicalpowerAbstractToservepersonnelhealthsecurityisthecoreoftheprisonhumanrightsnotonlycandirectlyreflectthenationalhumanrightssecuritysituation,morereflectsthesocialcivilizationandtheprogressofdemocracyandtheruleoflaw,butalsoforourcountryinthenewperiod,theharmonious,civilization,ruleoflawcanrealizethegoalofprison.Thispapertoservemedicalpersonnelrightasthemainresearchobject,sixpartsareintroduced.Thefirstpartmainlyintroducestheresearchbackground,researchpurposeandsignificanceandresearchsituation;Thesecondpartmainlyintroducestheprisonersfromrights,includingtherightoftheconcept,theconceptofservingpersonnelrightsandservepersonnelshouldenjoytherightsofthethreeaspects;Thethirdpartformedicalrightsthecorrespondingintroduction,includingmedicalrightconceptdefinition,thecontentsoftherighttomedicaltreatmentandmedicalrighthumanrightsattributeanalysisthreeaspects;Thefourthpartmainlyintroducestheprisonstaffinmedicalrightproblemsandshortcomings,includingservingpersonneltoprovidemedicalandhealthresourcesarescarceandtheprisonstaffemergencytreatmentwasrightinfringement,toservetherightofmedicalpersonneladministrativeresponsibilityvacancy,toservethejudicialreliefofmedicalpersonnelrightlackfouraspects;Thefifthpart,aimingattheaboveproblemsputsforwardthecorrespondingsecuritymeasures,includingprisonstafftoupdatethetraditionalconceptandprisonersfrombasicmedicalrightsguaranteesystemconstructionofthetwoaspects,inordertoserveourcountrymedicalpersonnelrightprotectiontoprovidecorrespondingreferenceandb
